1. About Us

The website shop.drsoil.co.uk is operated by Dr.Soil Ltd, registered in England and Wales (company number 13664634, registered office 3 Westbury Close, Houghton Regis, Dunstable). References to “we”, “our”, and “us” are to Dr.Soil Ltd. References to “you” or “Customer” are to the individual purchasing Goods for personal, non-commercial use.

2. Pre-Contract Information

Before placing your order, please read these Terms carefully. By placing an order you agree to be bound by them. These Terms do not affect your statutory rights. Key information about the main characteristics of our Goods, the total price including taxes, delivery arrangements, and your right to cancel is provided during the checkout process and forms part of these Terms.

3. Orders and Acceptance

Orders may only be placed online through our website. When you place an order, you will receive an acknowledgement email. This is not acceptance of your order. A Contract is formed only when we send you a dispatch confirmation. We reserve the right to refuse or cancel any order if:

  • Payment is declined or not authorised;
  • The delivery address provided is incomplete, inaccurate, or flagged by our fraud systems;
  • The Goods are unavailable or withdrawn from sale;
  • We reasonably believe the order is fraudulent or made in breach of these Terms.

If we cancel your order, any payments already made will be refunded in full.

4. Price and Payment

All prices displayed on our website include VAT where applicable. Delivery charges are shown separately before you confirm your order. We may change prices at any time, but such changes will not affect orders already confirmed. Payment must be made at the time of order using one of the methods specified at checkout. All cardholders are subject to validation and authorisation checks by the card issuer.

5. Delivery

We deliver only within the United Kingdom unless otherwise specified. Delivery dates are estimates; time is not of the essence. Unless otherwise agreed, delivery will take place within 30 days of order confirmation. Goods may arrive in more than one parcel. If we cannot deliver within 30 days, you will be informed and may either agree a new date or cancel for a full refund.

Risk of loss or damage passes to you upon delivery. Ownership transfers upon delivery. We are not responsible if you fail to provide a correct delivery address or safe access for delivery. If delivery fails due to your fault and the parcel is returned to us, we may recharge delivery costs.

6. Inspection and Faulty Goods

You should check the Goods promptly after delivery. If Goods are faulty, damaged, not as described, or unfit for purpose, you are entitled to a replacement or refund under the Consumer Rights Act 2015. To report a fault, please contact our Customer Service team at info@drsoil.co.uk. Nothing in these Terms affects your statutory rights.

7. Returns and Right to Cancel

You have a legal right to cancel within 14 days from the day after delivery without giving any reason. To cancel, you must notify us in writing (email or post). Goods must be returned within 14 days of cancellation, unused and in their original packaging. You are responsible for return shipping costs unless the Goods are faulty. Refunds will be made within 14 days of receiving the returned Goods or proof of postage.

Sealed Goods Exception: For hygiene and safety reasons, once certain products have been opened (such as bags of substrate or bottles of fertiliser), the right to cancel does not apply unless they are faulty or misdescribed.

8. Warranties and Liability

We warrant that the Goods will conform to description, be of satisfactory quality, and fit for their intended purpose. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or breach of statutory rights. We are not liable for losses which are not foreseeable when the Contract was formed, such as loss of profit or business interruption. Our liability is limited to the amount paid for the Goods.

9. Force Majeure

We will not be liable for delay or failure to perform our obligations due to events outside our reasonable control (natural disasters, strikes, pandemics, regulatory actions, etc.). In such cases we will inform you and you may cancel for a full refund.

10. Intellectual Property and Website Use

All content on our website (text, graphics, logos, images, software) is owned by or licensed to us. You may use our website only for lawful purposes and personal use. You may not reproduce, copy, or exploit any part of the website or its content without our written consent.

11. Data Protection

We process personal data in accordance with UK GDPR and the Data Protection Act 2018. Please review our Privacy Policy for details on how your data is used and your rights.

12. Changes to Terms

We may update these Terms from time to time. The version that applies to your order will be the version available on our website at the time you place the order.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
